Terms and Conditions of Sale

These Terms of Service ("Terms") govern your access to and use of highprotekstore.com (the "Site") and every purchase you make from High Protek Store ("we", "us"). Please read them carefully. By using the Site or placing an order you agree to these Terms, to our Return and Refund Policy, our Shipping Policy and our Privacy Policy, which are incorporated by reference. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state, to make a purchase. The Site is not directed to children under 13 and we do not knowingly collect personal information from them; if we learn that we have, we delete it. By ordering you represent that you are legally capable of entering into a binding contract and that the payment method you use is yours or you are authorized to use it.

3. Delivery

We ship to the United States. Orders are processed within 1–2 business days; at checkout you choose Economy Shipping (USD 11.44, 8–16 business days, free on orders of USD 179 or more) or Fast Shipping (USD 30.99, 8–12 business days). Every order includes tracking. If we cannot ship within the promised time we notify you before that date with a revised date and the right to cancel for a full refund; if the delay exceeds 30 days or is indefinite, the order is cancelled and refunded unless you expressly agree to wait. Full details, including our fulfillment locations and how import duties are handled, are in our Shipping Policy, which is part of these Terms.

4. Placing an Order

When you complete checkout you make an offer to purchase the items in your cart. We confirm receipt by email and accept the offer by dispatching the goods; until then either party may cancel. We reserve the right to refuse an order — for example if a product is out of stock, a price was displayed incorrectly, our fraud checks are not satisfied, or the delivery address is outside our shipping regions — and in that case we refund you in full within 7 business days. Quantity limits may apply to some products.

5. Prices and Taxes

All prices are shown in USD. The price of an item is the price displayed at the time you place your order. Sales tax is calculated at checkout based on the shipping address and shown at checkout. The total shown at checkout — items, shipping and taxes — is the total you pay; we do not add fees afterwards. When we advertise a discount, the reference price is a price we actually charged before the promotion. We correct pricing errors when we find them; if an error affects your order we contact you before shipping with the option to confirm at the correct price or cancel for a full refund.

6. Refund and Cancellation Policy

You may cancel an order free of charge before the order ships and return most items within 90 days of delivery for a refund or exchange. Items must be unused and in their original packaging; certain products are non-returnable for hygiene or legal reasons. Returns are free — we cover return shipping. Returns are sent to 15 Cleveland Avenue, Everett, MA 02149, United States. Approved refunds are issued 5–10 business days after we receive and inspect the item to the original payment method, and refunds for cancelled orders within 7 business days. Damaged, defective or incorrect items are replaced or refunded at our cost. The complete Return and Refund Policy is part of these Terms and is presented to you before checkout.

7. Payment Methods and Billing

Accepted payment methods: Visa, Mastercard, American Express, Discover, PayPal, Apple Pay, Google Pay and Shop Pay. All transactions are handled by Shopify Payments (powered by Stripe) using industry-standard encryption; card details never touch our systems. Charges are made at the time of order and show on your card statement as HIGHPROTEKSTORE.COM. Orders may be held for verification when the billing and shipping details do not match or our provider detects unusual activity; we will contact you if we need anything. For any billing question, write to info@highprotekstore.com and we will look into it right away.

8. Warranties and Disclaimer

Products are covered by the 12-month limited warranty against manufacturing defects described in our Return and Refund Policy. To the extent permitted by law, any implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, are limited in duration to the term of that limited warranty. Because Massachusetts law does not allow limitations on implied warranties in consumer sales, that limitation does not apply to you. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. The Site itself is provided "as is" and we do not warrant that it will be uninterrupted or error-free.

9. Liability

To the fullest extent permitted by law, High Protek Store and its owner are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits or data, arising from your use of the Site or any product, and our total liability for any claim related to an order is limited to the amount you paid for that order. This limitation does not apply to liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection statutes. Some jurisdictions do not allow the exclusion of certain damages, so parts of this section may not apply to you.

10. Products and Availability

We make every effort to describe products accurately and to show them as they are. Colors may vary slightly with your screen settings, and dimensions are approximate unless stated as exact. Our products are unbranded, generic items sourced from selected manufacturers; any brand names appearing in descriptions are for compatibility reference only and do not indicate affiliation. Product availability is not guaranteed until an order ships; if an item becomes unavailable we contact you with the options of waiting, a substitute or a full refund. We do not use false scarcity or countdown claims.

11. Use of the Site and Customer Reviews

Use the Site lawfully and in good faith: no fraudulent or unauthorized orders, no attempts to breach security, no automated scraping, no abuse of discounts. Reviews on our product pages come from customers who bought the product; we take reasonable steps to verify them and never commission fake reviews. Content you submit must be truthful and yours; you allow us to publish it and we may remove anything inappropriate.

12. Our Content

The Site and everything on it, including the High Protek Store name and logo, images, copy and design, belong to us or our licensors. You receive a limited, revocable license to use the Site to shop; no other rights are granted. Copying our content for commercial use, scraping the Site or reusing our images requires our written consent. Notices of alleged infringement should be sent to info@highprotekstore.com.

14. Disputes

These Terms and any purchase are governed by the laws of the State of Massachusetts and applicable U.S. federal law, without regard to conflict-of-law rules, and by the Massachusetts Consumer Protection Act, M.G.L. c. 93A where it applies. Please contact us first at info@highprotekstore.com: almost every issue is resolved by our support team within a few days. Arbitration agreement. If a dispute cannot be resolved informally within 30 days, you and we agree that it will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its consumer rules, rather than in court, except that either party may bring an individual claim in small claims court. Class action waiver: claims may be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. You may opt out of this arbitration agreement by emailing us within 30 days of your first purchase. This section is governed by the Federal Arbitration Act. Nothing in this section prevents you from filing a complaint with the consumer protection office of your state attorney general or with the Federal Trade Commission.

15. Changes, Severability and Entire Agreement

We may update these Terms from time to time; the version in force when you place an order applies to that order, and the current version is always available on the Site with its "last updated" date. If any provision is found unenforceable, the remainder continues in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies incorporated by reference, are the entire agreement between you and us regarding the Site and your purchases. You may not assign your rights under these Terms; we may assign ours to a successor of the business.
